Specifications include, but are not limited to: Contract counsel will be assigned to defend KSAP and state employee drivers. Representation will frequently begin with an assignment to respond to a settlement demand or Complaint received by KSAP, though assignments may also be issued in anticipation of litigation. Assignments will usually involve larger or more complex claims, with OGC handling claims that are more routine or of lower value. Assigned cases may be located at various locations throughout the Commonwealth and involve drivers employed by a variety of agencies operating various agency vehicles. Accident fact patterns may include emergency response and pursuit situations in addition to more routine automobile operation. Cases involving emergency response and pursuit scenarios may involve review and analysis of agency driving policies, in addition to factors common to other auto accident cases. Contract Counsel will handle representation of assigned cases under the strategic direction of KSAP Coordinating Counsel, with day-to-day representation the responsibility of Contract Counsel. Attached KSAP Counsel guidelines, Billing Practices, and Procedures detail standards applicable to Contract Counsel awarded a contract pursuant to this RFP.
