Specifications include, but are not limited to: • Furnish all personnel, labor, transportation, materials, supplies, and services and otherwise do all things necessary to satisfactorily fulfill this agreement. • Be responsible for wages, insurance, per-diem or any other costs associated with the activities of their employees. • Be responsible for providing required training and safety equipment for their employees. • Obtain required permits and clearances to carry out the project. • Take appropriate actions necessary to ensure safe working conditions • Make necessary arrangements for storage of tools and supplies. The Agency is not responsible for any lost, damaged, or stolen property. • Be responsible for all cleanup work at project sites prior to final inspection. • Be held liable for any damages which occur because of his/her negligence or that of his/her employees. • Indemnify and hold harmless the Agency, State, its officers, agents, or employees, against liability, claims, damages, losses, or expenses arising out of bodily injury to persons or damage to property caused by, or resulting from, contractor(s) and/or its employees, own negligent act(s) or omission(s) while contractor and/or its employees, perform(s) or fails to perform its obligations and duties under the terms and conditions of this Price Agreement. This Save Harmless and Indemnification Clause is subject to the immunities, provisions and limitations of the Tort Claims Act (Section 41-4-1, et seq., N.M.S.A. 1978 comp. and Section 56-7-1 N.M.S.A. 1978 comp.) and any amendments thereto. • Provide invoices to the Agency on a mutually agreed upon schedule which accounts for State Fiscal Year requirements.
