Specifications include, but are not limited to: Contractor must meet a minimum of Level 1 PCI Compliance. Claims Manager’s Practices The Contractor shall promptly undertake, through proper and lawful means, the collection of all claims referred to it by State Fleet without regard to the amount. The Contractor shall not, under any circumstances, use any unfair or illegal practices in the collection of the claims or violate any guidelines established by any other state or federal agency having jurisdiction. The Contractor shall use its "best efforts" to achieve maximum recovery of the claims referred to it for collection. The Contractor shall not have authority to accept a compromise settlement for any account without the written consent of the state. The Contractor shall agree to suspend action, either temporarily or permanently, on any account upon receipt of written notification by State Fleet. The Contractor shall have the capability in all respects to perform fully the requirements in this RFP and the resulting contract, and the integrity and reliability, which will assure good faith performance. The Contractor shall not use subcontractors for any claim collection services. Reporting requirements The Contractor shall provide the State Fleet with the reports listed below in sections 3.3.2 through 3.3.4. The state reserves the right to define the reporting methods to be used. Remittance Reports shall accompany monthly remittances. Remittance Report shall include: date of claim payment, insurance company or responsible party’s name, insured’s name, vehicle make, model and VIN, amount of collection, and itemized computation of the Contractor commission. Upon request by the state, the Contractor shall provide the state with the record of collection activity, including communications with the insurance company by date and mode for each claim. The Contractor shall furnish to the state such other account status and management reports as may be reasonably required by the State Fleet. Technical/System management The Contractor will need the ability to interface with State systems for transactional data. The system used currently is CARS. Any programming costs required to meet this requirement shall be the responsibility of the Contractor.
