a. The successful Supplier shall be capable of properly disposing of any hazardous and nonhazardous waste generated at West Virginia University (“University” or “WVU”). The university is a multi-faceted educational facility with many departments that generates both hazardous and non- hazardous waste streams that are regulated by the United States Environmental Protection Agency (“USEPA”) as well as the West Virginia Department of Environmental Protection (“WVDEP”). It is University policy to dispose of these waste streams in an environmentally safe and cost-effective method. It is our desire to enter into a contract for disposal with a qualified firm for a period of one year, with options to renew annually, for a maximum contract time of Eight (8) years, as mutually agreeable by both parties. It is the intent of this document to provide the terms and conditions applicable to this proposed waste disposal contract. b. The University recognizes its responsibilities to ensure that its facilities are in compliance with existing regulations imposed upon departments and affiliates which generate wastes and facilities that transport, store, treat and dispose of hazardous and non-hazardous waste streams. The University has a need to contract for hazardous waste transportation and disposal services from the private sector. WVU acknowledges, however, that the field of hazardous waste disposal services is a dynamic and ever-changing industry which is significantly impacted by state and federal regulations and by the influx of new technological developments. It is, therefore, mandatory that the successful Supplier demonstrate a high level of competence and technical expertise comparable to that obtained through extensive and aggressive compliance with appropriate hazardous waste management regulations. c. The University will work with the Supplier in scheduling on-site visits for the services to rendered at least 30 days in advance. In the event that an on-site visit is to be canceled, the University is accommodating to the rare instances of sick leave, breakdowns, weather hazards, and emergencies. The University always expects communication as early as possible and reserves the right to do the same. d.
