a. Assist the Boards in the investigation, preparation, and filing of disciplinary actions against persons or entities alleged to have violated provisions of the Kansas Pharmacy Practice Act, the Uniform Controlled Substance Act, the Food, Drug and Cosmetic Act, the Kansas Optometry Act, any other Kansas law or act administered by the Boards, and any accompanying Kansas Administrative Regulations thereunder. b. Prosecute all disciplinary actions filed by the Boards against licensees or registrants. c. Prosecute all disciplinary actions filed against non-licensed persons who are engaging in the practice of pharmacy, optometry, or holding themselves out as a licensee or registrant. d. Defend actions filed against the Boards, its members, and its employees. e. Represent the Boards on all appeals of any matters taken before any District Court in Kansas, the Kansas Court of Appeals, Kansas Supreme Court, U.S. District Court for the District of Kansas, and 10th Circuit Court of Appeals. f. Provide legal advice to the Boards. g. Act as General Counsel to the Boards on all matters, including providing counsel when asked and when Attorney believes the Boards may act differently if provided additional counsel they may not know to request. h. Attend in-person or by video call, as determined by the Boards, and provide counsel at all Board meetings and investigative reviews. i. As requested, j. Attend and provide counsel at committee meetings. k. Provide counsel to the PMP Advisory Committee. l. Review agency contracts and make recommendations for changes. m. Review and respond to Kansas Open Records requests; and n. Provide counsel regarding agency grant awards and obligations.
