3.1.1. Develop and deliver professional development programs for IHOs who conduct impartial due process hearings for students with disabilities as required by IDEA (including all other federal regulations in IDEA). 3.1.1.1 The scope, number, and frequency of professional development programs shall be determined by the STATE Point of Contact (POC) in consultation with CONTRACTOR, and shall cover both substantive and procedural due process issues under the IDEA and Chapters 60 and 61 of Title 8 of the HAR, inclusive of judicial interpretations emphasizing decisions from the United States Supreme Court, United States Ninth Circuit Court of Appeals, trends specific to Hawaii, as well as identified areas of needed skill development; and 3.1.1.2 The trainings shall be delivered via webcast or in person at the discretion of the CONTRACTOR in consultation with the POC. 3.1.1.3 Develop all professional development program materials and send the materials electronically to POC at least five (5) business days prior to the presentation date for printing and delivery to training site. 3.1.2. Provide Section 504 professional development and technical assistance to the IHOs separate from IDEA training and submit to POC the amount of hours and a description of the nature of professional development and technical assistance provided after the training is completed. 3.1.3. Provide technical assistance to the IHOs and the SEA, on an as needed basis, upon request by the POC or individual IHO. Any technical assistance provided to an IHO shall not compromise the independence of the IHO. 3.1.4. Review all decisions and orders issued by the IHOs within the contract period and provide feedback, as needed, to the IHOs. 3.1.5. To identify areas of strengths and needs, review portions of the verbatim record of hearings, provided by the IHOs, including possible trends, at least twice a school year (July 1 through June 30). The CONTRACTOR may use these reviews as a part of the annual IHO evaluation provided to POC for professional development training purposes. 3.1.6. Keep abreast of leading IDEA and Section 504 case law nationally and withinHawaii federal district courts.
