Specifications include, but are not limited to: This Request for Proposals (“RFP”) is issued to solicit proposals from qualified, experienced, responsive financially sound responsible law firms to provide legal and guardianship services for certain inpatients at UK HealthCare (“UKHC”) who meet the following criteria: • The patient has been assessed by a either a physician or neuropsychologist who has determined the patient lacks decisional capacity • The patient has no known next of kin or any identifiable kinship is unwilling or unable to act as a surrogate for the patient, known as “unbefriended” • The patient is excluded from state guardianship pursuant to KRS 210.290 and related regulations • The patient needs a guardian to make decisions on his/her behalf pursuant to KRS Chapters 311 and 387 as further outlined below. The specific activities and services for which the University is seeking services include: • Conferring with hospital social services staff regarding patients who meet the criteria above • Conferring with and communicating with clinical staff such as providers and nurses regarding patient condition, scope of healthcare needed, prognosis, healthcare decisions to be made, placement and ongoing healthcare needs • Reviewing medical records • Preparing and filing petitions and other relevant documents to obtain and provide guardianship services on behalf of UKHC patients • Preparing and filing motions regarding pending cases, such as for substitution of counsel • Review of documents and informal advice • Drafting briefs, motions, and memoranda • Drafting formal opinions when required • Conferring with Court personnel to facilitate the guardianship process • Appear at guardianship hearings • Communicate Court findings and Orders to UKHC providers and staff, and make necessary decisions regarding care and as otherwise permitted by law • Prepare a monthly report regarding actions taken on behalf of UK HealthCare patients and the status of each matter • Conferring with UKHC Risk management counsel and University counsel regarding unique issues affecting UKHC patients; and • Making decisions regarding disposition of the patient’s body in accordance with KRS 367.93117
