Please note: This is a Sole Source Notification. Specifications include, but are not limited to: a) This sole source determination applies to the purchase of PowerBuilder CloudPro from Appeon software licenses. Agency is purchasing annual subscription renewal for the software through Oregon’s Software Value-Added Reseller (SVAR) price agreement with SHI, Inc. (Vendor). PowerBuilder CloudPro from Appeon is the only product on the market that meets Agency requirements, as described in the attached Determination of Brand Name Specification (see Attachment 1). b) Appeon PowerBuilder CloudPro is a development platform, language, and integrated development environment used for the maintenance and operations of Oregon ACCESS, TRACS, and TWIST applications. c) Agency first purchased Sybase PowerBuilder in 1996 when Oregon ACCESS, TRACS, and TWIST applications were first conceived. Appeon has since taken over the management and licensing of the PowerBuilder software. d) Agency determined a sole source procurement is necessary for this purchase because Appeon owns the product. The service is the foundation for the Oregon ACCESS, TRACS, and TWIST applications and could not be replaced without a rewrite of the applications. This would result in violations of federal and legislative requirements to administer the ODHS and OHA programs supported by the PowerBuilder applications. e) Agency will post notice of this Sole Source Determination and Brand Name Specification on OregonBuys for seven days. If no protests are received, Agency will award a contract to Vendor at the end of that time. This method of procurement is one of the options for selecting a product for purchase from SVAR price agreement #PO-10700-00014971.
