Specifications include, but are not limited to: Molalla River School District is seeking qualified firms to provide Commercial Real Estate Consulting/Broker Services. Sale of real property is exempt from compliance with the Public Contracting Code, so there is no public bidding or RFP process required, ORS 279A.025(2)(f). However, the School Board must adopt a resolution declaring that the property "is not required for school purposes" and directing that it be sold, ORS 332.155(5). The School Board must also make the final decision approving the sale of the property, unless the decision is delegated to the superintendent (which they could do as part of the "not needed for school purposes" resolution). School Districts can list the property with a broker, sell it in a private sale, do a public offering, or sell it in any manner they think is in the best interest of the District. See ORS 332.155.
