Specifications include, but are not limited to: The Contractor shall perform Job Orders for the Regional Group specified on the Cover Page and Invitation For Bid Summary. However, DEP may assign the Contractor to perform Job Orders in other Regional Groups that are set forth in Volume I, Section I (Map of Regions), if DEP determines that, in its sole discretion, the entity assigned to perform the Job Orders in the corresponding region is unavailable. An entity is unavailable if: 1. That entity’s workload has resulted in a lack of staff availability to complete a Job Order in a timely manner; 2. The entity has failed to meet deadlines or has failed to perform in a satisfactory manner for a previously issued Job Order, as reflected in a performance evaluation; or 3. DEP’s ability to complete projects in accordance with the respective schedules would otherwise be jeopardized due to lack of available funds.
