Specifications include, but are not limited to: General Support 1. Create, operate, and maintain the STR registration system 2. Understand and apply the ordinance to impacted properties, owners, and/or registrants 3. Provide recommendation for program implementation based on industry best practices, available data, and technology 4. Track inventory of STR’s operating in Clackamas County 5. Identify and engage with noncompliant STR operators 6. Respond to phone and email inquiries regarding the program 7. Escalate issues as necessary and enforce section 8.10.080 (see below) of the ordinance. 8. Provide reports at agreed upon intervals Short Term Rental Registration 1. Coordinate the registration of all unregistered short term rentals with the exception of those that qualify for an exemption under section 8.02.060(C). 2. Assist applicants through the registration process with the application forms, including but not limited to a signed affidavit of compliance, and its requirements including: • The location of the premises • The true names, telephone numbers, addresses, and email addresses of the property owners • That the use complies with all building and fire standards and all other applicable requirements in section 8.10.050 • That the applicant has submitted a Transient Room Tax registration form to the County. • The name, telephone number, address, and email address of a contact person who shall be responsible and authorized to respond to complaints concerning the use of the short-term rental • Proof of liability insurance coverage on the short term rental • Owner must prohibit STR renters from subleasing the property or otherwise using it to generate income, must terminate the rental agreement immediately upon learning of such activities, and must not rent to anyone who the owner has reason to believe intends to use the STR for such activities • That the owner will continue to comply with the standards and requirements of this chapter Initial and Ongoing Compliance 1. Create and maintain an inventory of short term rentals in Clackamas County 2. Coordinate the collection of a .85% STR administrative fee of the amount charged for occupancy of the STR 3. Monitor, track, and document complaints of all components of the ordinance including but not limited to occupancy, noise, garbage, posting of contact information for the responsible party to deal with complaints, building and fire safety, and code-compliant pool and hot tub barriers. Should an immediate serious fire or life safety risk be discovered by vendor, the risk shall be immediately be reported to the Clackamas County Building Official. 4. When non-compliance is suspected, coordinate the issuance of two warnings on behalf of the County advising the owner and/or registrant of the alleged violations. In the event the warnings do not result in compliance, the vendor shall complete enforcement consistent with section 8.10.080 up to and including a Final Order issued pursuant to Chapter 2.07, and then referral to Counsel’s office for further enforcement.
