LEGO Education United States is the only authorized distributir in the United States of the LEGO Education produts listed in the appendix to this letter for use in the classroom(K through Grade 12), and provider in the United States of LEGO Education Academic Professional Development trainings nad e-Learning modules. 1. Is there truly only one Vendor who is able to furnish the product or service? Does the supplier possess exclusive capabilities? What are they? Yes, LEGO Education is the inly authorized distributor for the items and services outlined in the request LEGO Education is the creator, manufacturer, and publisher of their kits and related curricula. 2. IS there a lack of responsive competition for the product or service? Why? How have you verified this? LEGO Education copyrights and protects their product lines and professional development content. No other competitor can provide the same product and service. 3. Is the product or service vital to the District? Why/How? Yes. It will grant expenditures for Title I Part A, Title II Part A, and Title IV Part A equitable share. 4. Is the product or service unique and easily established as one of a kind? Why/How? Yes, LEGO Education provides unique, one-of-a-kind products and professional development services that are exclusive and not permitted to be replicated by other manufacturers or content creators. 5. Can requirements be modified so that competitive products or services be used? No. The items requested were selected for their high-quality product/content area that is easy for teachers to implement and students to use. Products and services are supported by copyrighted curricula, lesson plans and related online resources. 6. What would the user agency do if the product or service were discontinued? If LEGO Education discontinued their product lines and services, the LEA would consult with schools receiving equitable share to determine other activity options for grant funds. 7. Are there patented or proprietary rights that fully demonstrate: A feature providing a superior utility not obtainable from similar products. Product availability from only one prime source and not merchandised through wholesalers, jobbers, r retailers where competition could be encouraged? LEGO Education has patents on their products and copyrighted curricula and related materials. Currently, they are the sole distributor of the requested items and services.
