Specifications include, but are not limited to: 1. Equipment The Provider shall own and have in good to excellent condition all equipment necessary to landfill or incinerate municipal solid waste that is delivered to the disposal facility pursuant to the federal, state and local rules and regulations of the facility’s operational permits and licenses. 2. Work Standards All work shall be performed in full accordance with the federal, state and local rules and regulations of the disposal facilities’ operational permits and licenses, and to the complete satisfaction of the Town. The Provider must meet all federal EPA and OSHA guidelines in the proper handling and disposal of municipal solid waste delivered to the disposal facility. 3. Rate Increase Based upon Consumer Price Index The proposed per ton disposal fee may be made subject to annual adjustments in accordance with the Consumer Price Index – Urban, Northeast, All Items (“CPI-U” herein) as provided by the US Department of Labor. If so subject to adjustment, on January 1, 2025 and January 1, 2026, the per ton rate bid shall be adjusted by the full percentage change in the CPI-U of the immediately preceding November 1 through October 31 period. For the purposes of bid analysis, the Town will use an annual increase of 2%. 4. Definition of Solid Waste The Town refers to the definition provided under RSA 149-M:4. For the purpose of solid waste disposal under this Invitation to Bid, we are looking to dispose of “Refuse” as that term is defined in RSA 149-M:4, XXI: “Refuse'' means and includes any waste product, solid or having the character of a solid rather than a liquid in that it will not flow readily without additional liquid, and which is composed wholly or partly of such materials as garbage, swill, sweepings, cleanings, trash, rubbish, litter, industrial or domestic solid wastes; organic wastes or residue of animals sold as meat; fruit, vegetable or animal matter from kitchens, dining rooms, markets, food establishments or any places dealing in or handling meat, fowl, fruits, grain or vegetables; offal, animal excreta, or the carcasses of animals; or accumulated waste material, cans, containers, junk, or other such substances which may become a nuisance. The only exclusions from disposal are offal, animal excreta in substantial quantities or the carcasses of animals, and any waste deemed by US EPA to be Hazardous Waste by Federal Regulation. Separated recyclables that are contaminated by significant quantities of nonrecyclable solid waste in the opinion of the Town and/or of a recycling Provider, shall be disposed under this Contract at the specified per ton rate as long as the non-recyclable solid waste meets the definition of Refuse above. The Town’s solid waste stream for disposal at a commercial landfill or waste to energy facility includes bulky wastes, including stuffed goods and residential, homeowner-delivered, small quantities of (i.e., pick-up truck loads or smaller) construction/demolition debris. The Town expects under the contract to dispose of all Refuse meeting the definition presented in Section VI.4 of this Invitation for Bid. If the proposer has any restrictions or exclusions on acceptable waste materials, including, but not limited to, contaminated recyclables, bulky wastes or incidental resident delivered construction/demolition debris, such restrictions or exclusions shall be explicitly specified by the proposer in an addendum to the bid. After the bid proposal submission deadline, restrictions or exclusions not so stated in an addendum to the bid proposal shall not be considered by the Town. 5. Organic and Textile Wastes The Town has an optional drop-off program at its transfer station for residential food waste for delivery to a local food waste composting operation. The Town also diverts textiles to other vendors through drop-off containers at its transfer station or through a home pick-up service.
