Specifications include, but are not limited to: The purpose of this Invitation to Bid (ITB) is to purchase Goods as listed in this ITB for the Oregon Department of Corrections (ODOC). Goods indicated in this ITB are to be delivered to the ODOC’s Central Distribution Center (CDC), 3601 State Street, Salem OR 97301. Goods furnished under this Contract shall be subject to inspection and test by the ODOC at times and place determined by the ODOC. If the ODOC finds Goods furnished to be incomplete or the Goods or delivery otherwise not in compliance with ITB specifications, the ODOC may reject the Goods and notify Contractor as to whether Contractor may cure the nonconformance. If cure is permitted, ODOC may require Contractor to either correct the Goods without charge or deliver the Goods at a reduced price, whichever is equitable under the circumstances. If cure is permitted and Contractor is unable or refuses to cure any defects within a time deemed reasonable by the ODOC, the ODOC may reject the Goods and cancel the Contract in whole or in part. Nothing in this paragraph shall in any way affect or limit the ODOC's rights as buyer, including the rights and remedies relating to rejection under ORS 72.6020 and revocation of acceptance under ORS 72.6080, or any other rights or remedies available to the ODOC under this Contract.
