Specifications include, but are not limited to: The purpose of this RFP is to enter into a contract to provide: Administrative Law Judge Services; The administrative law judge shall conduct adjudicative proceedings; may take any action that is not a final dispositive action; shall submit to the Executive Director a proposed dispositive action including written findings of fact, written conclusions of law, and a recommended order. Duties of the ALJ may include, but are not limited to: Schedule and conduct formal and informal hearings. Rule on admissibility of evidence; evaluate evidence and render decisions or recommendations on dispositions. Explain differences between administrative hearings and judicial proceedings to litigants, attorneys and others. Resolve procedural issues such as requests for intervention, stays, continuances, or settlements. Issue subpoenas, schedule conferences, establish pre-hearing requirements including stipulations, discovery, briefing, pre-filed factual and expert testimony, and the use and marking of evidence and exhibits. Question witnesses and consider testimony and weigh evidence that is presented. Issue written interim and final procedural orders, make rulings on motions, testimony and evidence. Make and prepare post hearing findings of fact, conclusions of law and recommended orders. Maintain a complete administrative record of the proceedings. Render timely decisions and recommended decisions and where applicable comply with the timeliness requirements imposed under Utah Code Ann.§ 19-1-301.5(12) (13) and (17). -Perform all services in accordance with the standard of care in the industry for services of this magnitude and type.
