Specifications include, but are not limited to: 4.1. Testing shall be conducted on 10 layers of filter paper. 4.1.1. No more than 25% of the cigarettes tested in a test trial in accordance with this section shall exhibit full- length burns. Forty replicate tests shall comprise a complete test trial for each cigarette tested. 4.1.2. The performance standard required by this section shall be applied only to a complete test trial. 4.2. Written certifications shall be based upon testing conducted by a laboratory that has been accredited pursuant to standard ISO/IEC 17025 of the international organization for standardization (ISO) or other comparable accreditation standard required by the state fire marshal. 4.3. Laboratories conducting testing in accordance with this section shall implement a quality control and quality assurance program that includes a procedure that will determine the repeatability of the testing results. The repeatability value shall be no greater than 0.19. Quality control and quality assurance program" means the laboratory procedures implemented to ensure that operator bias, systematic and non-systematic methodological errors and equipment-related problems do not affect the results of the testing. Such a program ensures that the testing repeatability remains within the required repeatability values 4.3. A certificate of analysis will be provided to the Office of the State Fire Marshal for all samples rated as “PASS”. 4.3.1. An evaluation of “PASS” indicates the samples meet a performance standard where no more than 25 percent of the cigarettes tested exhibit full length burns. 4.4. Each cigarette listed in the certification shall be described with the following information: (1) Brand or trade name on the package (2) style, such as lights, ultra lights, or low tar (3) length in millimeters (4) circumference in millimeters (5) flavor, such as menthol, chocolate or other, if applicable (6) filter or non-filter (7) package description, such as soft pack, box or other (8) the name, address and telephone number of the laboratory (9) the date that the testing was conducted. 4.5. An example of the certificate and information format will be provided with bid information for review. 4.6. Samples for testing will be provided by the Office of the State Fire Marshal on a quarterly basis and will submit approximately 10 to 15 different brands at each submittal. Pricing and bid would be based on a per brand cost that includes all related expenses for such as shipment of samples to and from the lab testing site, testing, and administrative duties. 4.7. The office of the State Fire Marshal will submit up to 100 individual cigarette sticks per brand for adequate sticks for testing. 4.8. The laboratory will secure and retain all used cigarette sticks for at least 90 days and then properly return any unused cigarette sticks to the Office of the State Fire Marshal. 4.9. Proper chain of custody will be maintained with documentation / signatures from the time of submittal through the time of unused cigarette sticks are returned to the Office of the State Fire Marshal. 4.10. The independent testing and results will remain confidential between the Office of the State Fire Marshal and the laboratory unless written permission is given. 4.11. The Office of the State Fire Marshal may release the results to any person, party, or organization as it deems necessary.
