Specifications include, but are not limited to: Legal services to represent MOA in litigation in a construction contract dispute pending in the Superior Court, at Anchorage. The Plaintiff in the case is Pinnacle Construction, Inc., and the claim derives from the Z.J. Loussac Public Library Entry and Upgrades project. Pinnacle filed its lawsuit on December 5, 2022. MOA filed a timely Answer and the matter is scheduled for a 10 day jury trial commencing April 1, 2024. A detailed claim document was submitted by Pinnacle seeking $1.6 M and includes delay, impact and other damages. Services shall include pretrial discovery and motion practice, trial and possibly appeal. No formal discovery has yet occurred, but the parties previously exchanged substantial information relating to the Project and the claim. The nature of the claims asserted by Pinnacle involve a high volume of records to be catalogued, prepared for discovery, analyzed and organized for presentation at trial. The delay and impact claims require analysis to determine whether the purported delay or impact was caused by MOA.
