Specifications include, but are not limited to: This RFP seeks to retain the services of Special Litigation Counsel to provide legal services to DoF representing the State Defendants in the above-referenced Action. In addition to DoF, the State Defendants include the Secretary of Finance, the Director of the Division of Revenue, and the State Escheator, each of whom are named in their official capacities. In the Action, plaintiff seeks to preliminarily and permanently enjoin DoF s demand under Delaware s escheat laws, and challenges DoF s examination methodology under a variety of theories. Among other theories, plaintiff asserts that DoF s demand for payment: constitutes a violation of its due process rights under the U.S. and Delaware Constitutions would, if honored, represent an unlawful taking under the U.S. and Delaware Constitutions and violates the Commerce Clause and Full Faith and Credit Clause of the U.S. Constitution. Plaintiff has sought both preliminary and permanent injunctive relief. Defendants have filed an Answer to the Motion for a Preliminary Injunction and a Motion to Dismiss the Complaint.
