Specifications include, but are not limited to: The services required of an Administrative Fair Hearing Officer will be provided on a contractual basis upon need of service. The Department of Health and Social Services intends to contract with one or more qualified and experienced entities to conduct Administrative Fair Hearings, Provider Hearings or Mediation services. The purpose of this contract is to make available upon need, entities that can mediate and resolve administrative appeals in the best interests of the State and Client / third party vendors in accordance with State regulations, impartiality and the public. Examples of the types of services that a successful bidder will be required to provide are as follows: - Preside over fair hearings to determine the eligibility for and receipt/denial of public assistance benefits, pursuant to Titles 16 and 31 of the Delaware Code and federal law. - Preside over hearings to determine penalties against Medicaid providers, both institutions and health care professionals, pursuant to Title 16 of the Delaware Code and federal law. - Preside over hearings for placement on the Adult Abuse registry and the Certified Nurse Aide Registry, pursuant to Titles 11 and 16 of the Delaware Code and federal law. - Preside over hearings to impose civil monetary penalties, pursuant to Title 16 of the Delaware Code and federal law. - Preside over permit/licensure hearings pursuant to Title 16 of the Delaware Code and federal law.
