Congress enacted Title V of the Indian Health Care Improvement Act to make health care services accessible to American Indians and Alaska Natives residing in Urban Areas. Title V ensures Urban Indians benefit from the specially authorized health care and referral services and provides Urban Indian Organizations with the ability to carry out these programs through grants and contracts provided by the Indian Health Service. Through IHS and the Urban Indian Contractors, Congress ensures the continuation and continuity of such health care. Title V stipulates that to be eligible to receive contracts under this section, contract recipients must meet specific qualifications. The applicant must be a non-profit body situated in an urban center. The non-profit must be governed by a board of directors that is controlled by Urban Indians and must provide for maximum participation of all interested Indian groups. This statutory requirement precludes sources that do not meet these qualifications from competing for these contracts.
This class of acquisitions are governed by the Snyder Act of 1921 (25 U.S.C.§13), the Transfer Act (42 U.S.C. 2001), Title V of the Indian Health Care Improvement Act (P.L.94-437), as amended, and the Buy Indian Act (25 U.S.C.§47).
