(a) If an item in this solicitation is identified as "brand name or equal," the purchase description reflects the characteristics and level of quality that will satisfy the Government’s needs. The salient physical, functional, or performance characteristics that "equal" products must meet are specified in the solicitation.
(b) To be considered for award, offers of "equal" products, including "equal" products of the brand name manufacturer, must-
(1) Meet the salient physical, functional, or performance characteristic specified in this solicitation;
(2) Clearly identify the item by-
(i) Brand name, if any; and
(ii) Make or model number;
(3) Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and
(4) Clearly describe any modifications the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modifications.
(c) The Contracting Officer will evaluate "equal" products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer.
(d) Unless the offeror clearly indicates in its offer that the product being offered is an "equal" product, the offeror shall provide the brand name product referenced in the solicitation.

11.104 Use of brand name or equal purchase descriptions.
(a) While the use of performance specifications is preferred to encourage offerors to propose innovative solutions, the use of brand name or equal purchase descriptions may be advantageous under certain circumstances.
(b) Brand name or equal purchase descriptions must include, in addition to the brand name, a general description of those salient physical, functional, or performance characteristics of the brand name item that an "equal" item must meet to be acceptable for award. Use brand name or equal descriptions when the salient characteristics are firm requirements.
No harassment of vendors will be tolerated by the USDA.
The SOW for acquisition of feral swine traps is as follows:
Feral swine damage and subsequent control measures has been an ever-growing issue with Southeastern states and subsequent Territories, including Alabama, USVI, and Puerto Rico. Eliminating damage to agriculture, property, Natural Resources (threatened and endangered species), etc. from the offending species (Feral Swine) is a priority with our program. To combat damage and disease related issues on a special Urban Feral Swine Project in Puerto Rico, our program will require tools to conduct damage management activities for Feral Swine in remote communities around the island of Puerto Rico. Damage Management activities include trapping, night operations, aerial surveillance, etc. A key ingredient identified for operational success is to include the use of smart traps and thermal cameras for the team to detect, remotely monitor and trap target animals. The equipment in question could be utilized on a daily basis; throughout the year. The smart traps would need to provide remote surveillance of trapping area and the ability to trigger the trap remotely via cellular communication. The thermal scope and handhelds will allow detection and removal of the remaining individuals that are resistant to trapping efforts. Due to the large number of traps, we will require small trailers to haul the traps along narrow urban city centers we have been requested to work. The equipment in question would also increase employee productivity which increases cost efficiency when dealing with cooperators due to the high drive time that is required from the personnel to the work site daily to otherwise check the trap manually. The primary location we would utilize this equipment will be in Puerto Rico. Due to the remote and limited nature of the work location (Island of Puerto Rico) we are requesting to purchase travel trailer make and models that are already common on island to enable service and repair work to be more available. We have identified the Jager Pro M.I.N.E. trap system as a suitable smart trap system and small trailers designed for carrying those traps.
