The Portsmouth Naval Shipyard in Kittery, ME, intends to negotiate on a sole source basis with Delta Controls, 3 Pope Road, Windham ME, for services to provide complete troubleshooting, maintenance, and repair services on the control systems located on the Dry Dock #1 Refueling Complex (DD#1 Complex) and Dry Dock #2 Equipment Storage Enclosure (ESE-1) at Portsmouth Naval Shipyard (PNS). The control system is mainly comprised of “Delta” electronics/programming. IB Controls is the only technical representative for Delta products in the Kittery, ME area and maintains proprietary ownership of the system’s programming code. The statutory authority for other than full and open competition is 10 USC 2304(c) (1), only responsible source and no other supplies and services will satisfy the agency requirements.
