Specifications include, but are not limited to: A. Specimen Collection Provide collection sites statewide for pre-employment, random, reasonable suspicion, post-accident, return to duty, and follow-up testing. Collection sites statewide must provide and maintain “After Hours” coverage for reasonable suspicion, and post-accident testing. Provide that the location and collection of specimens ensure a dignified, professional, and confidential environment. Have in place a current policy for maintaining chain of custody procedures as outlined by FHWA rules and ensure the confidentiality of results. Supply appropriate quantity and types of specimens to meet proficiency requirements. Establish multiple collection sites throughout the State capable of administering all required tests. Provide that collection sites for alcohol testing shall have trained Breath Alcohol Technicians (BAT) meeting OTETA regulations. Evidential Breath Test (EBT) devices must meet the specifications of the National Highway Traffic Safety Administration (NHTSA). Provide procedures and schedules for transportation of specimens to testing laboratories. Provide a method of compliance with the blind specimen requirements of the program. B. Laboratory Services Provide that the testing laboratory is certified by the U.S. Department of Health and Human Services (HHS) under the National Laboratory Certification Program (NLCP); or have a current contractual agreement for services which are in compliance with all Federal as well as State laboratory regulations, standards, and procedures. Provide that the laboratory shall conduct testing and storage of specimens according to OTETA regulations. Provide that negative results for drug tests shall be reported to a Medical Review Officer (MRO) within twenty-four (24) hours; confirmed positive results shall be reported to an MRO within fortyeight (48) hours. Provide that all results reporting, and monthly summaries shall be forwarded to the MRO and the State of Maine DER according to OTETA regulations using confidential protocol. Provide that the laboratory shall have in place all the equipment required to meet OTETA regulations. C. Medical Review Officer Provide that the MRO is a licensed physician who has knowledge of substance abuse disorders and has appropriate medical training to interpret and evaluate drug test results. Provide that the MRO shall investigate information, evaluate data, and make a determination as to the positive or negative status of drug tests. Provide that the documentation of all test results shall be in accordance with applicable rules and regulations and are provided in conformity with the U.S. Department of Transportation procedures for Transportation Workplace Drug and Alcohol Testing Program 49CFR Part 40 reporting requirements.
