Specifications include, but are not limited to: A. Concessionaire shall provide all labor, materials, supplies, and any other equipment not provided by the City for the operation of the concession stand. B. Maintain all equipment including cleaning and regular ongoing maintenance. The City is not responsible for the replacement or repair of Concessionaire’s equipment. C. Concessionaires may add equipment as needed. Any new permanently affixed equipment provided by the concessionaire must receive prior written approval from the Parks and Recreation Department Manager and become the property of the City. D. The concessionaire is responsible for staffing, stocking, and maintaining the Family Aquatic Center’s concession stand during designated events and regularly scheduled days of operation. This includes “open swim”, members only swim, City events, and when services are requested for facility rentals. (Exhibit A) E. As an independent contractor, Concessionaire shall provide contractual concession services for a period of one year. The center opens for school district use the last week of the school year calendar and is open to the public Memorial Day Weekend through Labor Day. F. Successful bidder must comply with all Arkansas Department of Health guidelines. G. Exercise independent direction and judgement in executing obligations under this agreement, and shall pay all state and federal income, social security, and sales taxes applicable to Concessionaire’s sales. H. Maintain accurate books of account which show all of Concessionaire’s gross sales. Such books of account should be made available to City for examination at any reasonable time and place. I. Concessionaire shall be responsible to supply, schedule, and supervise its employees. a. The concessionaire’s employees shall be well-trained and experienced in providing the work including proper food handling. b. Concessionaire shall ensure staffing levels are sufficient to meet customer always needs the Concession is open to the public. c. Concessionaire shall ensure its employees behave in a professional, courteous manner to all customers, vendors, and City staff. d. At the request of the City, Concessionaire shall immediately remove any employee exhibiting unprofessional manners, which includes, but is not limited to, the use of profanity, inappropriate clothing, and combative or aggressive behavior. e. Concessionaire shall ensure its employees are always well-groomed with clothing in neat and clean condition. Clothing must be free of any form of advertising except that of the Concessionaire or City of Siloam Springs. f. All employees shall wear name tags in a location on the uniform where the first name is visible to customers. J. Responsible for cleanliness inside the concession stand, outside counters, and eating areas (tables, ground, and trash) directly adjacent to the concession stand.
