Specifications include, but are not limited to: This Invitation for Bid (IFB) is issued by the Office of Procurement (OP) to obtain pricing and a contract(s) for Medicaid Administrative Hearing Officers to conduct impartial hearings of appeals including, without limitation, the following: • Involuntary Discharge or transfer from Long Term Care Facility • Medicaid Providers • Long-Term care facilities • Long-term care administrators; 1. DHS will assign each appeal to a hearing officer as they are received. Upon notification of appointment by DHS, Contractor shall schedule a date and time for the hearing in a manner selected by the Contractor (inperson, telephonic, virtual, etc.). All hearings must be scheduled and heard in the time frames required by federal and state laws and regulations. 2. Contractor must set schedules for the exchange or submission of documentary evidence, briefs, and statements of fact. B. Record Contractor must prepare a Statement of Facts/Recommendation, or final order as appropriate to the type of hearing, and administrative records to be filed in judicial reviews. In matters resulting in a Final Order, the Contractor must provide the Final Order to all parties in the case. C. Involuntary Discharge or transfer from Long Term Care Facility 1. Unless waived by both parties, the Contractor must initiate the hearing withing fourteen (14) calendar days of the date of the filing of the notice of appeal. 2. Contractor must issue a final determination and order within seven (7) calendar days of the completion of the hearing. D. Hearing of Appeals of Medicaid Providers, Long-Term care facilities, and Long-term care administrators 1. Unless waived by the appealing party, Contractor must initiate the hearing within forty-five (45) days of the date of the filing of the notice of appeal.
