Specifications include, but are not limited to: Assign a Project Coordinator (PC) to oversee all aspects of contract compliance and completion and serve as single point of liaison between Contractor and SCPRT and/or any other involved entities. This PC must remain the PC through entire engagement. PC contact information is to be provided to the SCPRT PC upon award. Contractors PC and SCPRT’s PC will participate post-award site visits. Other involved personnel on either side may be invited at the discretion of each entities PC. Provide at least one ISA Certified Arborist to be onsite during operations ISA Certified Arborist contact information and certification copy is to be provided to SCPRT PC with response. Schedule and perform work in accordance with the “Timeframe”. Provide SCPRT’s PC with an update at the end of each work week (Mon-Thurs) summarizing progress. Carry out tree assessment, removal, and pruning work. Provide SCPRT PC with a georeferenced map compatible with Avenza denoting locations and classifications of trees to be removed/pruned or have the Contractor’s arborist show the SCPRT PC trees to be removed/limbed to be mapped by SCPRT PC. An example of a map is attached at the end of this document. (Appendix A) The spread of non-native invasive species is a concern for SCPRT. As such the contractor should take special care to make sure all off-road equipment used on park property has been thoroughly cleaned of potentially invasive, non-native plant material before moving on site. This includes the removal of all soil, plant parts, seeds vegetative matter or other debris that could contain or hold seeds. This includes but is not limited to checking and cleaning radiators, grills, tires, rims, tracks, undercarriage and tops of vehicles, blades, mulching heads, harvesting attachments and places where seeds and plant parts can stick to grease, fluids and mud (seal, bearings, etc.). “Off-road equipment” includes all logging and construction machinery, except for log trucks, chip vans, service vehicles, water trucks, pickup trucks, cars and similar vehicles. The Contractor shall employ whatever cleaning methods are necessary to ensure off-road equipment is free of non-native invasive plant species. Disassembly of equipment components or specialized inspection tools is not required. The Contractor (and any applicable subcontractor(s)) shall not use SCPRT Property in any unlawful manner or in any manner that will constitute a nuisance and shall be solely responsible for obtaining any permits necessary for conducting the activities authorized by this Agreement. The Contractor and any of his/her subcontractor(s) shall ensure that vegetation management activities do not in any way impair the ability of SCPRT to access SCPRT’s Property. Contractor and its subcontractor(s) shall promptly repair any damage caused in the course of vegetation management activities to roads or bridges providing access to SCPRT’s Property. Ensure that all persons operating any equipment, for the assessment, removal, or pruning of trees at Myrtle Beach State Park, do so in a safe consistent manner. Ensure that all employees or subcontractors wear and use appropriate protective/safety gear during all phases of work on the property as specified according to the International Society of Arboriculture Safety Standards. At minimum, maintain an eyewash station and first aid kit on site when employees are working. Comply with all laws, ordinances and regulations of all legally constituted authorities having jurisdiction over any part of this work. These requirements supplement the specifications and shall take precedence in case of conflict. Ensure that the work area remains free of trash and food scraps by removing all trash/refuse from the contract area prior to leaving on a daily basis. Ensure that no mechanized vehicles enter the forest. All vehicles must remain on roads, road shoulders, or in specified equipment areas. Ensure that vehicles are parked in an approved staging area when not performing treatment work. Ensure that no vehicles unless approved by SCPRT remain on-site overnight. Have an affirmative duty to protect from injury and damage the land, property, and other interests of SCPRT. Damage includes, but is not limited to, all costs and damages associated with or resulting from the release or threatened release of a hazardous substance occurring during or as a result of the contractor’s activities on, or related to, the lands, properties, and other interests covered by the contract. Compensate in full the State of South Carolina/SCPRT for damages occurring under the terms of the contract or under any law or regulation applicable. The contractor shall be liable for all injury, loss, or damage, associated with the contractor’s use or occupancy. Compensation shall include, but is not limited to, the value of resources damaged or destroyed, the costs or restoration, cleanup, or other mitigation, or other types of abatement costs, and all administrative, legal (including attorney fees), and other costs in connection therewith. Comply with all applicable federal, state, and local laws and regulations, including but not limited to: Federal Water Pollution Control Act, 33 U.S.C. 1251 et seq, Oil Pollution Act, 33 U.S.C. 7401 et seq Resource Conservation and Recovery Act, 42 D.S.C. 9601 et seq Comprehensive Environmental Response, Control, and Liability Act, 42 U.S.C. 9601 et seq, as subsequently amended The Endangered Species Act and the contractor shall indemnify, defend, and hold SCPRT harmless for any violations incurred under any such laws and regulations or for any costs, damages, claims, liabilities, and judgments arising from past, present, and future acts or omissions of the contractor in connection with the use authorized by the permit. This indemnification and hold harmless agreement includes, but is not limited to, acts and omissions of the contractor in connection with the use authorized by the contract which result in: (1) violations of the above or any applicable laws and regulations; (2) judgments, claims, or demands assessed against the SCPRT; (3) costs, expenses, and damages incurred by the State of South Carolina/SCPRT; or (4) other releases or threatened releases on or into land, property, and other interest of the State of South Carolina/SCPRT by solid waste and/or hazardous substance(s). Assume all risk of loss of property. Loss of property may result from, but is not limited to, theft, vandalism, fire, rising waters, winds, falling limbs or trees, and acts of God.
