Specifications include, but are not limited to: The following projects are funded in whole or in part by funds received from the FederalHighway Administration (FHWA), and their construction is wholly contingent on the state'scontinued receipt of those federal funds. If the federal funds are reduced or not received, theDepartment may choose to terminate any or all of the contracts for convenience under theprovisions of Subsection 108.10. Any bidder on these projects, by submitting its bidor bids, understands and accepts the possibility of the contracts being terminated in the event federal funds are reduced or not available and by submitting any bid, each bidder waives any claims for costs or damages other than as specifically allowed by Subsection 108.10.2.
