Specifications include, but are not limited to: SALE AND REMOVAL OF APPROXIMATELY 350,000 CUBIC YARDS OF FILL DIRT/CLAY MATERIAL ONLY 16-T6N-R3E AND EXCAVATION REQUIREMENTS. The Developer/Bidder shall be responsible for all of the costs, expenses and liabilities (if any) associated with the Grading/Fill Dirt/Clay Material Sale Project and shall be responsible for obtaining any required approvals, permits and/or authorizations required by law, rule or regulation and shall be responsible for strict compliance with all laws or regulations relative to the Dirt Sale Removal/Grading Project to be performed by Development/Bidder and hold harmless the District from any and all liability, financial or otherwise. 2. The Developer/Bidder shall perform and complete the Fill Dirt/Clay Removal/Grading Project in accordance with the Project Exhibits attached hereto and directions of School District Engineer and successful bidder shall retain an engineer (“Project Engineer”) to monitor the work to begin upon plan approval of the Engineer of the District (“District Engineer”); and such engineers shall jointly monitor the work and cooperate to completion of the Grading/Fill Dirt/Clay Sale Project.
