Specifications include, but are not limited to: 1.1 The CONTRACTOR shall be responsible for the disposal of all residential solid waste delivered to their site. The CONTRACTOR shall utilize a fully approved Subtitle D landfill, in accordance with Environmental Protection Agency and Arizona Department of Environmental Quality regulations. 1.2 The CONTRACTOR shall be responsible for properly disposing of the COUNTY’S residential waste in accordance with statutory and regulatory guidelines. 1.3 CONTRACTOR shall have the right to inspect and monitor all waste and to reject any waste that is determined to contain hazardous materials. 1.4 Acceptance by CONTRACTOR of materials relieves the COUNTY from any and all liability for materials contained therein and CONTRACTOR agrees to indemnify the COUNTY from all current and future claims as a result thereof. 1.5 Should the CONTRACTOR, except by reason of strike, act of God, or disaster, be unable to receive and dispose of the COUNTY’S solid waste for more than 48 hours, the County may, in addition to its other remedies provided in any Agreement, cause the solid waste to be disposed of at another fully approved Subtitle D landfill, in accordance with Environmental Protection Agency and Arizona Department of Environmental Quality regulations. Any increase in costs for disposal fees would be at the CONTRACTORS expense. The cost incurred by the County may be deducted as an offset from any money due the resultant CONTRACTOR or from the posted performance bond. 1.6 CONTRACTOR agrees to maintain a schedule that will insure receiving location is open a minimum of 40 hours per week, primarily during normal business hours (8am-5pm, Monday - Friday). Actual hours will be one of the factors used during the evaluation of the contract.
