Specifications include, but are not limited to: A. The Contractor shall be responsible for operating the home in compliance with Title 38 U.S. Code: Part 51: Per Diem for Nursing Home Care of Veterans in State Veterans Homes; 45 CFR Part 483, Subpart B – Requirements for Long Term Care Facilities; with the Arkansas Office of Long Term Care, Rules and Regulations for Nursing Homes; and with all other applicable Federal and State regulations.; B. The Home and its programs must be administered by a licensed Nursing Home Administrator employed by the Contractor and shall be subject to approval by the Secretary of the Arkansas Department of Veterans Affairs. This individual shall be licensed under the laws of the State of Arkansas and shall work closely with the ADVA on-site designee for the contract, who will be vested with the authority to verify that all contractual terms are met, and that high quality care is provided to residents of the Home. ; C. An Assistant Administrator shall be employed by the Contractor who shall be licensed as a Skilled Nursing Home Administrator under Arkansas State law. The Assistant Administrator chosen by the Contractor shall be subject to approval by the Secretary of the ADVA.; D. The Home must be staffed with qualified staff 24 hours per day, 7 days per week, 365 days per year, in accordance with all Federal and State regulations and USDVA State Home Per Diem Program and OLTC minimum staffing requirements.; E. The Contractor shall be responsible for all business office functions of a Skilled Nursing Facility including but not limited to billing, cash receipts, collections, management and maintenance of patient trust and donations accounts and payment of all expenditures.; F. The Contractor shall be responsible for all revenue billing and collections from USDVA, residents, and third parties.; G. The Contractor shall be responsible for payment of all costs of operating the facility unless specifically excepted. These include direct and indirect patient costs included in the Daily Rate, operating costs including but not limited to rent and utilities (the current lease rate is $44,982.00 per month and includes utilities), groundskeeping, computer hardware and software systems, information technology solutions, security system, badge system, administrative and overhead costs. The sole exception will be costs listed in Section 2.9.A through 2.9.C below, which will be borne by the ADVA.; H. Contractor shall be responsible for annual Medicare cost reporting, annual Medicaid cost reporting, monthly and annual USDVA State Home Per Diem Program cost reporting, CMS Payroll Based Journal reporting and all other periodic reporting requirements defined by applicable state and federal laws, rules and regulations for Skilled Nursing Facilities.; I. The Contractor shall be subject to an annual audit and shall cooperate with ADVA, Arkansas Legislative Audit, and Arkansas Division of Internal Audit in providing financial records of the facility and supporting documentation.; J. The Contractor shall provide to ADVA a standardized set of periodic revenue, cost, census, quality of care and operating reports to be defined and mutually agreed upon.; K. The Contractor shall cooperate with the ADVA designee in development and implementation of public relations and/or advertising programs.; L. The Contractor shall include the ADVA designee in all committee meetings involving the quality of care provided in the facility. The Contractor shall provide the ADVA designee a copy of each committee's minutes as requested.
