Please note: This is a Sole Source Notification. The Direct Care and Treatment (DCT) division of DHS intends to enter into an agreement with Netsmart Technologies, Inc. (hereinafter “Netsmart”), for up to eighty-four months. The agreement will provide software licensing, subscription services, advanced hosting, user monitoring, security services, and system maintenance of the multi-faceted electronic medical records system (hereinafter “system”) that is used by DCT.; DHS has determined that this is a single source purchase since Netsmart, as the creator of the software code, is the only provider of the proprietary software licensing, maintenance, and hosting services for the system that is used by DCT. None of these products or services can be obtained through a third-party vendor. DHS has determined that the system is the only solution that meets DCT’s existing requirements since the system integrates with other existing DCT systems. Furthermore, the costs and time to comprehensively train over 2,400 employees on a new system would negatively interrupt DCT’s service delivery and put the client/ patient care at risk. Netsmart’s contract is to include system maintenance and upgrades to ensure that DCT leverages state of the art technology as medicine evolves. Additionally, the hosting service level provided by Netsmart can only be achieved by Netsmart. No other vendor, including the State’s own IT Services, can provide a level of service that is the same or higher than the level that is guaranteed by Netsmart.
