Specifications include, but are not limited to: The Contractor will test water samples collected by CDFW at the 21 hatcheries for priority pollutants and other constituents. Due to the difference of testing schedules at each hatchery, testing will be conducted at the request of the Contract Manager, as part of the five-year NPDES requirements. Priority pollutants and metals to be tested are displayed in Exhibt A, Attachment 2. See Exhibit A, Attachment 3 for an estimate of sample sites for each hatchery that will require testing.; The Contractor will provide additional monthly testing of the consistuents displayed in Exhibit A, Attachment 2 if needed and upon request of the CDFW Contract Manager. The Contractor will only provide additional testing should unanticipated or emergency events occur causing CDFW’s lab to reach capacity.; Upon request from the CDFW Contract Manager, the Contractor will mail sample bottles (certified clean and pre-preserved) and coolers to the hatcheries listed in Exhibit A, Attachment 3. The Contractor will pay for these shipping costs and incporate any shipping costs into the cost per sample. Coolers must be able to adequately hold sample bottles, CDFW supplied ice, and be sent by overnight carrier (FedEx, Golden State Overnight, etc.). Sample bottles and coolers are to be sent to each hatchery no later than five business days after the CDFW Contract Manager requests the sampling materials. Contractor must determine the amount of water necessary to run each requested test, send the appropriate size and number of sample bottles (containing any necessary chemical preservatives), and coolers to cover the required number of sample sites for each hatchery. If the Contractor uses a subcontractor, the Contractor will ensure that the requestor receives any containers and special preservatives required by the subcontractor. CDFW employees will collect the samples of water at the CDFW hatcheries and send water samples to the Contractor in the Contractor supplied cooler by overnight mail or hand delivery. CDFW employees will label each sample bottle to identify the hatchery and sample site (i.e., influent, effluent, or upstream receiving water).; CDFW employees will also provide the pH results for each sample site. CDFW will pay for shipping the samples to the Contractor. The Contractor is responsible for shipments to subcontractors unless prior arrangements are made with CDFW personnel; the Contractor will pay for these shipping costs and incorporate any shipping costs into the into the cost per sample.; Within 21 business days of receipt of the samples, the Contractor will complete the analysis and deliver the report via email to CDFW Staff Chemist Gail Cho who can be contacted via email at Gail.Cho@wildlife.ca.gov or phone (916) 358-2840. See Section C below for report requirements.; The Contractor will be responsible for disposing or returning the samples. The Contractor will contact the CDFW Contract Manager before any samples are disposed of. CDFW is responsible for shipping costs of samples that are requested to be returned.; For samples that are received outside of United States Environmental Protection Agency holding times, the Contractor will contact CDFW to determine next steps. If directed to continue with the analysis, the Contractor will be compensated for the full price of the analysis only.; If any constituent(s) tests above the “criterion maximum” or “criterion continuous” allowable limits, as identified in Exhibit A, Attachment 2, CDFW may request additional testing for individual constituent(s) at the rates identified in the Line Item Budget. For this purpose, 10% of the contract amount will be added as a contingency. If additional tests are needed, the CDFW Contract Manager must notify the Contractor in writing (via email or mail).; CDFW reserves the right to request re-analyses of samples. If re-analyses confirms the original result, the Contractor will be compensated at the per sample rates identified in the Line Item Budget. Any analysis not performed in whole, or in part, in accordance with the provisions and requirements specified in this agreement, or with any approved test procedure, shall be rejected in its entirety and no payment shall be made therefore or for the results thereof. See Section C. Reports for deliverable requirements.; 2. The Contractor must comply with and ensure that all employees, subcontractors, and agents comply with all requirements of the Department of Transportation (DOT) regulations regarding waste transportation under this contract. Information regarding complete compliance with these regulations must be carried on transport vehicles and maintained at facilities where wastes are received, stored, or handled during transportation.; The Contractor and subcontractor must comply with the California Vehicle Code, California Highway Patrol (CHP), Title 13, California Code of Regulations; the California Fire Marshal regulations, Title 19, California Code of Regulations; and United States Department of Transportation regulations (49 CFR). The Contractor and subcontractor must comply with the California Health and Safety Code and Title 22, California Code of Regulations administered by the California Department of Toxic Substance Control and any other laws and regulations affecting the work under this contract.
