Specifications include, but are not limited to: The Contractor will provide services for the acquisition of property rights as required by the Borough for roads, trails, facilities, and other Borough uses. Activities include, but are not limited to: on-site property and project area inspections, environmental review, review of both plat and parcel drawings, owner identification, title research, document preparation, offers to and negotiations with both public and private owners, obtaining release and consent documents necessary to clear title to the subject property, and preparation of all acquisition documents including an Internal Revenue Service Form W-9. All original documents shall be transmitted to the Borough ROWAO for review and approval prior to payment processing. The Borough ROWAO will determine which parcel acquisitions will be closed by a title and escrow company. The Contractor shall deliver these parcel acquisition files to the Borough ROWAO for processing. The Contractor will review project plan sets and recommend best right of way practices for the most efficient acquisition of real estate or interests in real estate, which interests will include rights of way, public use and utility easements, temporary construction permits and easements, and right of entry authorizations for Borough projects by utilizing borough, state, and federal law and regulation as required. The Contractor will research and interpret title documents, write status reports as needed, review outside title reports for accuracy, research of record and off record documents and legal descriptions, and will be responsible for document development and drafting. The Contractor will investigate, determine, and document the existence of section line easements, public land orders, and right of way trespass issues and will prepare and provide to the Borough reports based on findings.
