Specifications include, but are not limited to: 25.1. Contractor shall maintain proper accounting records for all products purchased under the resultant agreement. For audit purposes upon request of the City, Contractor shall provide accounting of all charges and expenditures incurred. All such records shall be subject to examination and inspection by City authorities during normal business hours. 25.2. All products shall meet American Petroleum Institute (API) criteria and ratings where applicable. Vendor shall submit a copy of the API license and the product specification sheets for all products listed as part of this bid. 25.3. The meters on all bulk delivery trucks shall be certified as required by state law and local ordinance. Vendor shall submit a copy of the Weights and Measures Certification as part of the bid package. When making bulk deliveries, Contractor’s bulk delivery trucks need to park outside and shall have the hoses necessary to accommodate such deliveries. 25.4. Contractor shall guarantee availability of requested materials. Failure to provide materials for immediate delivery may be considered a material breach of the agreement and may result in termination of the contract. In the alternative, the City reserves the right to purchase nondelivered materials on the open market. Any additional cost associated with such a purchase shall be deducted from any amounts owed to Contractor. 25.5. Vendor shall state brand name/manufacturer for all items listed on the pricing sheets. If brand or manufacturer name is stated for item description, vendor will provide that brand. Contractor shall not substitute a brand different from that bid without the prior written consent from the City.
