Specifications include, but are not limited to: 2.0 ENERGY ACT ABANDONED SITE VISITS At the request of TCEQ, Contractor will conduct site visits at potentially abandoned UST locations. The site visits can occur in any of TCEQ’s sixteen (16) regions.; 2.1 Site Visits. Each site visit will involve an assessment to identify those facilities with USTs that are abandoned so that they are no longer included on the Energy Act (E-Act) investigation rotation. The Contractor will provide to TCEQ the results of the E-Act Abandoned UST Determination Investigation Checklist, Technical Compliance Rate (TCR) Checklist, appropriate documentation, and relevant observations.; The Contractor will conduct site visits in the following manner: a. Task Assignment. A site visit request, referred to as a Task Assignment, will be assigned by the TCEQ to the Contractor. Task Assignments will be assigned for individual facilities. Task Assignments to the Contractor will be initiated via e-mail. An example of the Initial Task Assignment form is included as Attachment A; b. Desk Review. Contractor will perform a thorough records review including, but not limited to, searching the TCEQ Central Registry including Leaking Petroleum Storage Tank (LPST) search, Secretary of State (SOS) Direct databases, TCEQ facility central records, CLEAR database (provided TCEQ is able to obtain access for the Contractor) and county property records.; c. Scheduling and Performance. Site visits must be entered into the online calendar one week prior to scheduled dates. The Contractor must have at least one Spanish speaking and writing representative in the event they are needed for scheduling and/or performing the assessment.; 3.0 COMPLIANCE SITE VISITS: 3.1 At the request of the TCEQ, Contractor will perform site visits at regulated facilities that have requested such visits from the TCEQ. Contractor will be required to maintain a minimum of five (5) key personnel to support this Contract. See the Evaluation Criteria Section for further details enumerating the qualifications of key personnel. The site visit will cover compliance with environmental regulations and identify opportunities based on standard, industry-specific Compliance Checklists (See Attachment E) developed by the SBLGA Section of the TCEQ. Contractor will conduct a compliance assessment of the regulated facility and provide recommendations toward meeting compliance standards outlined in the appropriate compliance checklist at the time of the assessment. Contractor may need to provide guidance to the facility in understanding and complying with environmental rules as well as limited assistance in completing necessary paperwork to comply with environmental rules.; 3.2 Contractor should expect to spend an average of one (1) to two (2) hours on-site at each regulated facility per Compliance Checklist for the site visit. The Contractor should expect to spend an average of four (4) to six (6) hours to prepare the site visit reports. Contractor should expect to conduct between fifteen (15) and twenty (20) site visits on average per month statewide. Depending on demand, Contractor may be required to conduct as many as fifty (50) site visits per month statewide. The site visits can occur in any of the TCEQ’s sixteen (16) regions. The primary regulated facilities requesting site visits include but are not limited to in service Petroleum Storage Tank (PST) and temporarily Out of Service (OOFS) PST facilities.; Contractor will conduct each site visit in the following manner: a. Task Assignment. A site visit request, referred to as a Task Assignment, will be assigned by the TCEQ to the Contractor. Task Assignments to the Contractor will be initiated via e-mail. An example Initial Task Assignment form is included as Attachment A.; b. Waiver of Liability Form. Prior to providing site visit materials, the Contractor must ensure that the business owner or an authorized representative signs the waiver (Attachment F) and returns same by e-mail, fax, or U.S. mail to the Contractor. The initial form will be provided by the TCEQ to the Contractor; photocopies will be the Contractor's responsibility thereafter.; i. This form must be signed by the facility representative and returned to the Contractor within 30 days of the scheduled site visit.; ii. Contractor must provide these signed forms to the TCEQ as a component of the Site Visit Report.
