Specifications include, but are not limited to: The State of West Virginia, Offices of the Insurance Commissioner (OIC) is seeking information (only) to assist in the preparation of specifications for prospective solicitation to obtain a pharmacy benefit manager for the stateadministered workers’ compensation funds. The funds include the workers’ compensation “Old Fund,” which are the legacy claims from the former state-run, monopolistic Workers’ Compensation Commission. Old Fund claims have a date of loss prior to July 1, 2005. The state-administered workers’ compensation funds also include the Uninsured Employer Fund ("UEF"), which includes claims made by employees of uninsured employer’s that have a date of loss on or after January 1, 2006; the CoalWorkers’ Pneumoconiosis Fund (“CWP”), which is for federal black lung claims with a date of last exposure prior to January 1, 2006, the SelfInsured Employer Security Fund, which is for claims against bankrupt or defaulted self-insured employers with dates of injury or last exposure prior to July 1, 2004; and the Self-Insured Employer Guaranty Fund, which is for claims against bankrupt or defaulted self-insured employers with dates of injury or last exposure prior to July 1, 2004. As of August 31, 2021, there are a total of 10,166 claims in all state-administered workers’ compensation funds.
