Specifications include, but are not limited to: The Delaware DNREC, Division of Climate, Coastal and Energy is seeking one or more qualified vendors to enter into contract(s) to provide financial expertise for the review of financial assurance instruments as they relate to Coastal Zone Act conversion permit applications (https://de.gov/cza). The estimated length of time for the contract is five (5) years, with specific services to be provided upon the issuance of task orders after agreed-upon costs for services. These services may include: 1. Review of the following financial assurance instruments for sufficiency and validity for an initial conversion permit application: Fully Funded Trust Fund, Letter of Credit, Insurance Policy, Surety Bond, a combination of these instruments, any other instrument approved by the Secretary of DNREC on a per-case basis; 2. Review of the aforementioned financial assurance instruments on an annual basis to ensure full coverage of the estimated Coastal Zone Financial Assurance Amount; 3. Review of the aforementioned financial assurance instruments in the event of a major modification to a conversion permit, such as a change in site ownership or control; 4. Review of capital cost estimates for implementation of Sea Level Rise and Coastal Storms Plans and Environmental Remediation and Stabilization Plans; 5. Review of financial assurance instruments for existing remedial activities on any given conversion permit site; 6. Development of guidance for instances where existing financial assurance for a site is not in the form of one of the pre-approved instruments outlined in the Regulations Governing Delaware’s Coastal Zone (7 DE Admin. Code 101); 7. Preparation of any recommendations, conditions, or provisions of an agreement to increase the security of the instrument in the interest of natural resource protection; 8. Other activities that support the mission of the Coastal Zone Act Program.
