Specifications include, but are not limited to: 1.1.Vendor shall have the exclusive right to arrange installation and operation of payphones at all of locations identified in the Service List within this RFP. 1.2.The State shall maintain the area around the payphones, and provide suitable space, safe and convenient access to the public and electrical power, if necessary, at State’s expense, for the use of the payphones. 1.3.The State shall provide vendor with access to the premises specified on the Service List during normal working hours. 1.4.The State shall take reasonable precautions to protect the payphones from damage, vandalism, theft, and hazardous conditions, and promptly report all such conditions and any service failures to the vendor. 1.5.In the event of any damages or theft to payphone(s), with approval by the State, the Vendor may condition continuance of the payphone(s) for reimbursement, from the State, for such losses. 1.6.The State shall not affix or permit to be affixed any signs, materials or information to the payphones or equipment. 1.7.Vendor shall have the exclusive right to provide or arrange for the provision of pre-subscribed interLATA calls in vendor’s name as the contracting party for all payphones covered under this RFP. 1.8.Vendor shall comply with all licensing and federal accessibility requirements upon execution of the awarded contract. 1.9.Vendor may install signs on or near the payphones to identify the payphones to users, and may install advertising for products and services that do not compete with State’s business, within or on the payphone enclosures, instruments and handsets. 1.10. Vendor shall not be responsible for providing text telephone, TDD equipment, or ramps, curb cuts or other changes to State’s property. 1.11. Vendor may not change the assigned pay telephone number(s) at any time at its sole discretion. 1.12. Unless mutually agreed upon, no payphones shall be relocated or removed from their location. 1.13. Upon permanent relocation or removal of any payphone, Vendor may leave in place and dedicate to State such equipment and facilities as concrete pads, bumper posts and underground conduit (“Transferred Equipment”) as the State may, in its sole discretion, determine to have continued usefulness, the ownership and responsibilities of which shall be automatically transferred to State unless State notifies Vendor in writing within thirty (30) days of the permanent relocation or removal of the payphone that Vendor must remove such Transferred Equipment.
