2. Scope of Work A. The County will purchase Hot Mixed Asphalt Concrete (HMAC) for which prices and contractor’s location have been submitted on the enclosed bid form whenever the County determines that the overall cost of purchasing HMAC from one contractor is lower than purchasing HMAC from another contractor. The County’s calculation of the overall cost shall be based on the contractor’s unit price and the County’s transportation costs. B. The County shall transport the HMAC from the Contractor’s place of business to the County’s work sites unless the County makes arrangements with the Contractor to deliver the HMAC to the work sites. In which event the Contractor may charge a reasonable fee for delivering the asphalt concrete. C. Contractor shall make the HMAC available at all times during the Contractor’s regular business hours as long as this contract remains in effect. D. The HMAC shall meet all applicable government laws, regulations and standards. In event the County determines that a load of HMAC does not comply with said laws, regulations or standards, the County shall notify the Contractor and the Contractor shall not charge the County for the load. The foregoing shall not be considered the County’s exclusive remedy for the failure of the HMAC to meet said laws, regulations or standards. E. The contractor shall agree to furnish HMAC to County trucks on a first-come-first-served basis. Whenever a backup of trucks waiting for material from the contractor’s plant occurs, County trucks will not be forced out of line for loading of material by trucks from other agencies, contractors or by the contractor’s own trucks
