Specifications include, but are not limited to: The Oregon Department of Education is responsible for collecting and ensuring the school districts satisfy their obligations for investigating and processing complaints of violations of statute or administrative rule for which the Deputy Superintendent has jurisdiction. As part of this responsibility, ODE is required to investigate appeals involving discrimination under ORS 659.850 and OAR 581-021-0046 and 581-021- 0046, restraint and seclusion under ORS 339.285 to 339.303 and OAR 581-021-0550 to 581-021-0570, retaliation under ORS 659.852, and standards-based violations under OAR Chapter 581, Division 022. The Department has determined that the most efficient way to conduct the investigations for these appeals is by using a pool of contract investigators. Review appeal and underlying complaint; In consultation with Department staff, determine scope and design of investigation; Communicate in writing, in person, and over the phone with parties and witnesses; Request and review documents, including documents from Department, School District, Appellant, and witnesses; Interview parties and witnesses; Perform site visits; Maintain detailed notes and investigation file; Progress reports via phone or email to ODE staff; and After consultation with Agency staff, write final document, which could include an investigative report, draft findings of fact, or a draft final order.
