4.9.1 All ingredients in Goods covered by these specifications shall be free from foreign material and shall have good color, flavor and odor, and shall be uniform and consistent in flavor, taste, aroma, and texture. 4.9.2 All Goods must comply with the Hazard Analysis Critical Control Point systems (HACCP) regulated by 21 CFR Part 120 and meet all other FDA/USDA Food Safety and Inspection Service regulations to ensure the Goods are safe for human consumption and accurately labeled. 4.9.3 PRESERVATION, PACKAGING AND LABELING: All Goods shall be prepared, processed preserved, packed and packaged under modern sanitary conditions, and cases shall be marked in accordance with Current Good Manufacturing Practice (21 CFR Part 110) and Food Safety and Inspection Service (FSIS). Shipping containers shall comply with the National Motor Freight Classification or Uniform Freight Classifications, as applicable. All packaging and containers with Julian dates must be converted to the Gregorian Calendar (Western Calendar) dates. 4.9.3.1 All containers must be code dated with actual date of manufacture in a 5-digit sequence to include date, year, and batch number. 4.9.3.2 All packaging shall be FDA/USDA approved commercial containers, suitable for use by government entities. All packaging must be non-breakable containers. Glass containers of any type will not be accepted. Good packaging with metal of any kind will not be accepted unless otherwise indicated in the ITB. 4.9.3.3 Staples shall not be used as a final case closure. Case closures shall be accomplished by taping, strapping or gluing. All containers within the delivery unit of an individual Good must be of uniform size and weight. Containers and packaging with holes are not permitted. 4.9.3.4 Maximum allowable case or tote weight is 50 pounds, unless otherwise specified in this ITB. Catch Weight cases, as defined in Section 3.1, “Definitions”, WILL NOT be allowed, unless otherwise indicated in the ITB. 4.9.3.5 Frozen Goods: All Goods to be delivered in a frozen state shall be frozen to an internal temperature of 0 degrees Fahrenheit or lower at time of removal from the holding facilities preparatory to shipment. All frozen Good(s) to be delivered to cold storage via refrigerated truck must be 10 degree Fahrenheit temperature or less. 4.9.3.6 All Good(s) shall comply with the allergen labeling requirements of the Federal Food, Drug and Cosmetic Act. 4.9.3.7 All Goods requiring Country of Origin Labeling (COOL) MUST be labeled per 74 Fed Reg 2658 (2009). Goods not labeled with COOL will be rejected by ODOC and disposed of at Contractor’s sole cost and expense as provided in Section 4.6 “Inspection and Rejection.” 4.9.3.8 All Goods must meet ingredient declaration as stated within each Good description. Contractor must submit a copy of Good label and Nutritional Facts Label within one (1) business days following request from the SPC listed in Section 2.2, unless otherwise specified in the ITB. 4.9.3.9 Good(s) that are considered Manufacture Rejects, Salvageable, Panel Dents or Distressed Good(s) as defined in Section 3.1, “Definitions”, WILL NOT be accepted by ODOC unless otherwise indicated in this ITB. 4.9.4 BEST USE BY DATE (BUBD)/PRODUCTION DATE: All food items delivered to ODOC must have a minimum one (1) year shelf life remaining prior to the stamped Best Use By date/production date, freeze by date or following the process or packed date, unless otherwise indicated in the ITB. Out-of-date food items will be rejected. 4.9.4.1 Only delivered Goods labeled with “Best Use By Date, Best If Used By, Use By, Process or Pack Date, or Best if Freeze By Date” will be accepted. BUBD is interchangeable with “Best Use By Date, Best If Used By, Use By, Process or Pack Date, or Best if Freeze By Date”. Goods labeled with “Expired or Expiration Date” will be rejected, and shall be disposed of at Contractor’s sole cost and expense as provided in Section 4.6. BUBD Julian dates must be converted to the Gregorian Calendar (Western Calendar) dates. 4.9.4. 2 All delivered Good(s) must be received with a continuing freshness guarantee as long as the Good is stored and processed according to label instructions. 4.9.5 If multiple FTLs or one-half truck loads (TLs) are required for this ITB, all FTLs and one-half TLs delivered MUST be as specified in the Contractor’s Bid, and of the same quality, wholesomeness, taste and nutritive value throughout ALL the deliveries. Substitute Goods not bid by Contractor but delivered to ODOC will NOT be accepted, and shall be disposed of at Contractor’s sole cost and expense as provided in Section 4.6.
