The City will contact the Title Company who shall propose the amount of compensation to perform the Work, and the proposed timeframe for completing the Work. At such time as the City and Title Company have approved the compensation and timeframe for completing the Work, and the City’s Finance Director has certified the funds payable with respect to the Work Order in accordance with the City’s certification procedures, Title Company shall proceed with the Work. (For avoidance of doubt, Title Company shall not provide any services under this Contract prior to the Effective Date and shall not perform any Work or be entitled to any compensation prior to receiving notification that the City has approved the proposed compensation and timeframe, and the City’s Finance Director has certified the funds for such Work Order.) The Title Examiner shall conduct a personal and professional review for each property assigned by the City, including all public records, judgments, liens and mortgages, easements, and other land titles thereon or belonging thereunto and advise the City, in a type-written report, of the Title Examiner’s opinion regarding the marketability of the title to real property (the “Title Report”). The Title Examiner shall update or supplement the Title Reports as requested by the City.
