INVITATION TO BIDDERS
NOTICE IS HEREBY GIVEN, pursuant to Section 103, Article 5A of the General Municipal Law that sealed bids are sought by the Village of South Nyack, Department of Public Works for the following;
ITEM: 1) Above Ground Fuel Dispensing and Storage System
SUBMITTING A BID DOES NOT GUARNTEE THE VILLAGE WILL AWARD ANY OR ALL OF THESE ITEMS BID.
Sealed bids will be received by The South Nyack Village Clerk at Village Hall 282 South Broadway, South Nyack, New York 10960 until 11:00 AM MAY 23, 2014 At which time bids will be publicly opened and read aloud.

Bidder To state delivery date with bid
Bidder to state all warranties & guarantees in full with bid
Bid price to include Delivery to the Village of South Nyack
Bid to exclude all Federal, State and Local Taxes, (exempt Municipality)
Bidder to include Manufacturer Warranty information with bid
Bid will be awarded to the Lowest, most responsive bid
The Village of South Nyack, reserves the right to waive any informalities and /or reject any and / all bids as deemed for the best interest of the Village.
Conditional or alternate bids will not be considered unless specifically requested in these specifications
The Municipal Law of the State of New York requires that bidder certify under penalty of perjury that bids have been prepared without collusion with other bidders, suppliers, etc., and such certification is attached to theses specifications
Sealed bids shall be submitted to the Village of South Nyack A Sealed envelope MUST indicate on the outside that a bid is enclosed and must indicate the item number and description of the Vehicle being bid upon, each item requires a complete and separate bid and bid envelope.
Any bid received after the date and or opening time as outlined in the invitation to bid will be considered unresponsive and will be returned to the bidder un-opened
The Village reserves the right to hold bids for a period of (30) days after opening in order to review bids before making an award
Terms of payment shall be after acceptance of bid item (s) by the Village of South Nyack as to conformance with specifications
The Village reserves the right to postpone bid openings for its own convenience
“Or Equal”- Whenever materials or equipment herein are specified or described in these specifications by using the name of a proprietary item or the name of a particular supplier, manufacturer, the naming of the item or manufacturer is intended to describe the type, function, and quality desired by the Village. If the bidder wishes supply an item of equal or better quality, the bidder shall provide in writing certifying that the proposed substitute is equal to or better than specified. Forms are included in this bid package for such proposal. The Village shall have the final determination on whether the proposed substitute is equal or not.
Any changes to these specifications will be made by the Village, by written addendum only. Addenda will be mailed only to those whose names appear on the list as having received bid specification package.
Any deviations from these specifications to be noted with bid, on separate sheet attached to these specifications which is noted as Compliance with Specifications. Failure to complete this form when there are deviations will result in rejection of bid complete.

Minimum Product Specifications:
1. “Envirosafe Fireguard” or approved equal 2. 2000 Gallon Split Tank Mounted on Saddles, 3. Split (2) 1000 internal tanks independent from each other 4. Internal Tanks must have Independent Bulk Head 5. 2 Product Dispensing Pump must have Containment and be an attached part of Tank 6. Each Tank must have independent Clock Gauge 7. Each Tank must have minimum 7.5 gallon overspill protection with Lockable Cap 8. Overall Storage Tank must have Engineered Hurricane Tie Down
9. Entire unit shall be Epoxy Primed and Acrylic Polyurethane Coated Painted Finish 10. Unit must have Interstitial Leak Gauge 11. Unit must have Anti Syphon Valves & Ball Valves with Smart Controller’s 12. Each Tank must have a Minimum 16” Man way for Inner Tank Access 13. Each Tank Fill must have a secured step ladder to access fill locations 14. Overall unit shall not be longer than 18’ feet in length 15. Overall unit height shall not be higher than 12’ feet 16. Overall unit width shall not be more than 73’ inches (not including access ladder) 17. Unit Must have 2 (Two) Lifting Lugs capable of supporting weight of Empty Unit for off loading 18. All equipment and piping must be Factory installed 19. Dispensing unit must be Dual Hose / Dual Product (Bennett or Equal) 20. Unit shall have all New York State and Federal Required Decal Markings and Identifications 21. Unit Manufacturer must supply minimum required pad specifications to Village 22. Unit Manufacturer must supply Electrical Requirement’s including Conduit Location once order is placed by Village 23. Unit must pass Requirement NFPA 30-30A including 2 hour Fire Test, Impact and Ballistic Test 24. Manufacturer must have minimum of Twenty Years in the manufacturing of fuel storage tanks 25. Unit must be shipped ready to install on Village Supplied Concrete Pad 26. Unit must only require Village Electrical contractor to make Power Supply hook up to Power up unit 27. Delivery to Village shall be included in Bid Price
28. The unit will use a (OPW Petro Vend 100) or approved equal, Fuel Management System able to operate with a (2) two Product Dispensing System, must be able to Track usage of minimum of (50) fifty Proprietary cards. Unit to be installed by an OPW Certified Technician on site in Village
