Specifications include, but are not limited to: The New York City Law Department (the “Law Department” or the “Department”) serves as the attorney and counsel for the City of New York, its agencies, and the New York City pension funds and retirement systems and retirement savings plans (referred to collectively herein as the “Funds”)1 . The Funds hold or in the past have held securities issued by companies listed on various exchanges in the United States and around the world on which the Funds may have suffered losses as a result of improper conduct, including, for example, fraud, corporate wrongdoing, material misrepresentations, and other violations of securities laws. Where appropriate, the Funds may seek to recover those losses by way of active participation in litigation. Pursuant to this RFP, the Law Department is seeking to establish a pool of appropriately qualified law firms, which will be available to serve, on an as needed basis, as evaluation counsel and litigation counsel (both as hereinafter defined) to the Department and the Funds. Evaluation counsel will assist the Law Department in evaluating potential securities claims and recommend courses of action with respect to particular litigation matters (“Evaluation Counsel”). Litigation counsel will serve as counsel or as co-counsel with the Law Department in specific domestic securities litigation matters undertaken on behalf of the Funds (“Litigation Counsel”). Counsel in the pool may also recommend and participate in recovery efforts outside of the United States.
