Specifications include, but are not limited to: (1) Legal Advice: Advise the City Council, City Manager and all City departments, bureaus, boards, and commissions thereof, concerning all legal questions arising in matters relating to their official duties; (2) Actions, Suits and Proceedings: When requested by the City Council or City Manager, shall prosecute or defend all actions, suits, proceedings, and controversies to which the City is party or in which it is any way interested. The City Attorney shall have the power to appeal from orders, decisions or judgements, and subject to the approval of the City Council, shall have the power to enter into any agreement, compromise, or settlement of any claims against the City; (3) Contracts and Other Instruments: Prepare or review all contracts and other instruments in which the City is concerned, and before execution thereof, shall endorse on each the approval of the form and correctness thereof when requested by the City Council or the City Manager. The City may continue to retain separate bond counsel for the purpose of issuing municipal bonds; (4) Attend Council and Committee Meetings: Attend City Council meetings, Planning Board, and other related municipal meetings when so requested for the purpose of giving the Council and municipal officials legal advice; (5) Make Reports: Immediately report the outcome of any litigation in which the City has an interest, to the City Manager and/or City Council. (6) Real Estate: Prepare deeds, easements and contracts pertaining to real estate and render title opinions on property being acquired or sold by the City; and (7) Keep Records: Keep a complete record of all suits in which the City has an interest, giving the names of the parties, the Court where brought, the nature of the action, the disposition of the case, or its condition, if pending, and the briefs of counsel. Keep a complete record of all written opinions furnished by him/her and of all certificates or abstracts of titles furnished by him/her to the City, or any department or official thereof.
