Chapter 428 of the New York State Laws of 1992 and Chapter 231 of the Laws of 1993, established an Early Intervention (EI) Program for children ages birth through two (0-2) diagnosed with developmental delays and their families, including provision for the County to provide transportation services. Eligibility for the program is determined by the County as part of each child’s Individual Family Service Plan (I.F.S.P.) Section 4410 of the New York State Education Law of 1989 established a Preschool Education (PSE) Program for children ages three through five (3-5) with developmental delays, including provision by the County to provide transportation services. Eligibility for the program is determined by Local School Districts as part of the child’s approved Individual Education Plan (I.E.P.) The contract(s) to be awarded pursuant to this RFP will require the Contractor(s) to provide transportation services for children ages birth through age 5 attending Early Intervention or Preschool Programs requiring transportation to Current Program Clusters listed in Attachment A. For the purpose of this RFP and any resultant contract(s) and interpretation thereof, it is agreed that the transportation of children with disabilities is a specialized function. It is the intent of the County that the children be transported to and from the Service Sites regularly, promptly, safely and without interruption or incident and that the interest of the children in such transportation shall take precedence over the interest of the Contractor and its Drivers, Attendants/Aides/ Monitors.
