Specifications include, but are not limited to: determining merchandise offered at the gift shop with therequirement that the gift shop will include the sale of shuttle service tickets and the NYS ParksDiscovery Pass.Merchandise shall be subject to NYPA’s approval. The use of any NYPA logo,image or graphic on any “branded” souvenir items relating to the Power Vista, Niagara PowerProject or the New York Power Authority must be reviewed and approved by NYPA prior to use. The CONTRACTOR is responsible for its own inventory.NYPA is not responsible for any lost,damaged or stolen merchandise.NYPA is not responsible for any loss of income either real orassumed by CONTRACTOR’s inability to operate within the Power Vista for any reasonincluding closure of the facility.
