1) The responsibilities of the petroleum inspector will be to take samples from bulk deliveries of oil, measure the oil in ship, barge, and/or shore tanks before and after discharge, perform laboratory tests to determine oil quality and produce certificates verifying both the quality and quantity of oil delivered in any particular shipment or pipeline transfer. These certificates will provide (i) the basis for payment for oil delivered. (ii) The basis for assessing penalties for non-conforming oil and (iii) evidence of compliance with environmental quality regulations. 2) All measurement, sampling and testing of oil shall be performed using the inspector’s own equipment and in accordance with American Petroleum Institute (“API”) standards as set forth in the “Manual of Petroleum Measurement Standards.” Quantity determination (measurement) shall be by gauging of shore tanks into which oil deliveries are made unless otherwise instructed by the Authority. Quality determination (testing) of oil samples shall be in accordance with the American Society for Testing and Materials for Petroleum Products (“ASTM”) using the test methods specified in Tables 1 through 3 herein. 3) The oil specifications set forth in the above Tables are for the following distillate fuel oil types: (i) Ultra Low Sulfur Diesel “ULSD” (Table 1), (ii) Ultra Low Sulfur Heating Oil “ULS-HO” (Table 2) and NYPA Specifications (Table 3) supplemental to the foregoing and priced separately – (see subparagraphs 14 and 15 below).
