1. The Contractor shall provide health related and professional services personnel on a temporary, non-permanent basis to meet the work requirements of the various units throughout the Fire Department. For the purposes of this Agreement, personnel shall mean experienced Contractor Employees possessing a specific occupation or vocation requiring training or advanced study in a specialized field. The Contractor Employee work assignments shall be for a limited time period to complete non-recurring, short-term projects, or to provide staffing continuity during the recruiting process for a permanent employee. 2. The Contractor shall be solely responsible for the direct recruitment and provision of personnel as directed with respect to the duration of assignment, work location and hours, job titles and numbers of positions. The Fire Department may at its own discretion, refer personnel to the Contractor for hiring consideration including, but not be limited to, Contractor employees employed under the existing contract, provided such Contractor Employee is interested in remaining on assignment. 3. The Contractor shall have sufficient resources to manage at least sixty (60) Contractor Employees and recruit personnel to meet the needs of the Department. 4. Contractor Employees shall be sufficiently skilled to meet, at a minimum, all qualification requirements set forth in Attachment A and shall perform the duties and assume the responsibilities described therein. 5. The regular hours of work for Contractor Employees shall be eight (8) hours per day, Monday through Friday, exclusive of City Holidays, with a one (1) hour unpaid meal period for lunch. The Fire Department reserves the right to change the hours of work as required. Such changes may include evenings, City Holidays, weekends, or overtime. 6. Contractor Employees may be assigned to any of the Fire Department’s facilities located throughout the five (5) boroughs of New York City. The FDNY Authorized Representative shall approve all assignments and reassignments. 7. The Fire Department shall supply the Contractor’s Employees with all material and equipment such required for reasonable accommodation for the performance of their work assignments. Any special equipment (other than standard office equipment) required to aid the employee in the performance of normal work duties shall be supplied by the Contractor at no additional charge to FDNY. 8. Each Contractor Employee shall receive work assignments from an FDNY Authorized Representative. The Contractor shall be required to report absence, lateness, or any other changes in status to such FDNY Authorized Representative at the work site. The Contractor shall maintain and submit time records as required by the Fire Department.
