Specifications include, but are not limited to: a. Services to be Provided. The Contractor shall provide the Services in accordance with the Work and Hour Schedule, annexed as Attachment 1. NYCEDC may modify the Work and Hour Schedule as needed and upon seven (7) days prior written notice. b. Communications. The Contractor shall work with NYCEDC Representative to provide a cordial, effective and safe work environment. The Contractor's personnel shall perform their duties in a professional manner. The Contractor shall communicate regularly with NYCEDC in the performance of the Services, which at a minimum shall include weekly meetings with the NYCEDC Representative and/or the NYCEDC Operation Managers. c. Supplies. The Contractor shall provide all supplies, forms, logs, log books, and related materials required for the Services. All records are to become the property of NYCEDC for the duration of the Contract. d. Quality Assurance Plan. Contractor shall have a quality assurance plan and a system of performance measurements in place that are mutually acceptable to NYCEDC and the Contractor. The system of measurements shall include, but not be limited to, the following: (i) A bi-monthly performance report on operations that includes a measurement of the discrepancy rate of performance requirements. (ii) A quarterly report on compliance with contractual stipulations regarding personnel qualifications and certification. NYCEDC shall review files maintained at Contractor's premises. (iii) A semi-annual assessment of Contractor’s implementation of the quality assurance plan and the responsiveness and involvement of its management team. (iv) A semi-annual assessment of Contractor's performance based upon a recorded sampling of tenants and their personnel. 2. Security Personnel a. General Requirements (i) The Contractor shall provide the following personnel to perform the Services (the “Security Personnel”): 1. Reception/Concierge 2. Access Control/Roving Security Guard 3. Shift Supervisor Security Guard/Unarmed Security Guard 4. Fire Safety Director (ii) The Security Guards must meet all federal, state, and city Legal Requirements for the Services, including training and registration requirements pursuant to the New York State Security Guard Act of 1992 (the “Security Guard Act”) contained within Article 7A of the General Business Law, as may be required by each Security Guard’s assignment. (iii) The Fire Safety Director (FSD) must meet all FDNY requirements in obtaining an F- 85 Certificate of Fitness. (iv) The Contractor shall complete and certify, for each Security Guard, as required by assignment, a “Certification of Compliance”, attached hereto as Attachment 2. The Contractor shall maintain the original Certification of Compliance and, upon NYCEDC’s request, shall produce it and any supporting documentation of Security Guards’ qualifications. The "Certification of Compliance" shall be reissued annually on the anniversary date for each such Security Guard assigned to the Corporation and copy filed in the Security Guard's file maintained by the Contractor. (v) The Contractor shall ensure that all Security Personnel have been drug-tested prior to performing the Services. The Contractor shall require each Security Personnel to provide a copy of satisfactory (negative) drug test result either through a urine sample or mouth swab (oral fluid) for, at a minimum, marijuana, cocaine, opiates, amphetamines, and phencyclidine, meeting Substance Abuse and Mental Health Services Administration (SAMHSA) standardized cut-off levels. Tests shall be performed within the sixty (60) day time period prior to the initial assignment of each Security Personnel. (vi) The Contractor shall conduct a random drug test for each Security Personnel within each twelve (12) month period after original assignment, for a minimum of the above listed drug classes. An NYCEDC Representative reserves the right to request drug testing of suspected user. (vii) The Contractor shall perform background investigations of all Security Personnel, which shall include, without limitation: Three-year prior employment check; Federal and State Criminal records, which shall include out of state criminal records of where Security Personnel was previously employed or resided; Credit check; Minimum of two personal reference checks; Any additional background checks as deemed necessary by the Corporation (e.g. psychological or integrity testing).
